RETURNS, CANCELLATIONS & CHANGES, FREIGHT & DELIVERY,  SCHEDULES & STORAGE, COM ORDERS,

ALL SALES ARE FINAL

All of our products are custom made and finished to order, there are strictly no refunds, no returns and all sales are final.

CANCELLATIONS/CHANGES

All acknowledged orders are considered as FINAL orders and are not subject to cancellation or revision. If for any reason cancellation is permitted it will be at the discretion of EMMEL FURNITURE through written consent. If approved, cancelled orders will be subject to a cancellation charge. No cancellations will be accepted on custom products. Since a lot of items may be manufactured to the customer’s specifications, we will not accept cancellations after the fabrication has been ordered.

LEAD TIME

Standard production lead time is around 6 weeks, delivery time not included. For pieces with custom specifications or orders of large quantities, EMMEL FURNITURE reserves the right to agree with the Buyer on a different lead time. Lead time for orders with COM/COL products only starts once the fabric or leather arrives at EMMEL FURNITURE’S office and is properly identified. All fabrics must be identified with the proper COM/COL Form that is sent together with the pro forma. EMMEL FURNITURE is not responsible for delays in production or any fabric misuse if the fabric is sent without proper identification by the Buyer.
 
PAYMENT CONDITIONS
 
Standard Product requires a 50% advance payment to start production. The production starts only after EMMEL has confirmed that the advanced payment value has been received.  The lead time starts counting on the day the order proceeds to production. The remaining amount must be paid until 3 days before the expedition date. EMMEL reserves the right to postpone the expedition date until full payment is received and confirmed.
All products are EMMEL’s property until the payment is fully received and confirmed.

SCHEDULE / DELIVERY CHANGES / STORAGE

Any delivery date change must be submitted in writing and approved by our services. If  customer is unable to accept an order when it is ready for shipment, storage may be requested and will be evaluated. Acceptance of storage will be at the discretion of EMMEL. All costs including transportation will be at customer expense. A storage charge will be assessed for every 30 days, or any part thereof, that merchandise remains in storage.  EMMEL considers this transfer to storage the equivalent of delivery for all purposes, including invoicing and payment. Customer accepts all risk of damage or loss during storage.

FREIGHT & DELIVERY CLAIMS

Emmel is not responsible for damages that occur during transportation or storage. All products are carefully inspected by our expert staff and are in perfect condition prior to shipping (or otherwise agreed previously between Emmel and the client, this concerning for example outlet items).  The carrier assumes all responsibility upon acceptance of products. All shipments should be opened and inspected immediately upon receipt. Claims for damages, shortages or overcharges should be placed with delivering carrier by the buyer or receiver of goods. It is the customer’s responsibility to inspect all products upon receipt and file ANY and ALL and claims with the carrier. Do not accept the shipment until all shortages and carton damage are noted on both the bill of lading and the freight bill. Concealed damage must be reported to the carrier within 15 days of receipt. Failure to make claims shall constitute acceptance of the products and waiver any claims of defects, errors or shortages. Hold product/packaging for carrier’s inspection.

COM orders will not be scheduled for production until the last fabric is received.

EMMEL MATERIALS AND FINISHES

EMMEL choses its parteners wisely for the production of the best pieces with the best materials.  EMMEL is not responsible if the handcrafted furniture contracts as moisture in atmospheric surroundings changes. Some materials may crack due to drastic temperature and climate changes. While this is a very rare occurrence, EMMEL cannot control nor will be held responsible for these forces of nature.

EMMEL  is also not responsible for the wear and tear to furniture due to everyday use or no proper maintenance. The finishes shown on our website have been reproduced as accurately as possible. Any difference uppon delivery in colour is accepted and not the responsibility of EMMEL.

PRODUCT DISPLAY

EMMEL shows pride to display the products and  images on our site as accurately as possible. However, since we cannot control the capabilities and limitations of each monitor or computer, we do not guarantee that your monitor’s display of any color, texture or detail of any actual merchandise will be accurate. Colors are not guaranteed. Due to color variability in computer and screen monitors, we have no liability if colors of the products do not match their display on the site. We reserve the right to change and discontinue products at any time without notice to the client.

All texts, pictures, references and materials on this site are provided to the fullest extent permitted by law, we disclaim all representations and warranties, expressed or implied, with respect to such material, including, but not limited to, the warranties or merchandise, suitability of said merchandise for a particular purpose, title, non-infringement and freedom from computer virus, and all warranties which may be implied from course of conduct or course of dealing. We do not guarantee that information contained on this site is accurate, complete, or current. All products and prices are subject to change without notice.

LIMITATION OF LIABILITY

EMMEL is not liable for any damages due to errors or omissions in the content of this site or any delay or inability to use this site at the fullest of its capacity by the client or damage to any computer, data or any other damages you may have during  connection with your access to and/or use of this site. Emmel is not responsible for any indirect, punitive, incidental, special or consequential damages arising in any way out of your use of this site or the materials contained herein, even if advised of the possibility of such damages. In no event shall EMMEL be hold responsible for damages due to circumstances beyond our control.

PRIVACY POLICY

EMMEL respects the privacy of its clients and in no circumstance will sell, rent, and/or trade your personal information to any third party. We limit the information we collect from you over the Internet to what is needed for conducting business and offering products and services that might be of interest to you.

MISCELLANEOUS

EMMEL reserves the right to terminate your access to the web site and all of its products if you violate any agreement or obligation you may have with us, or if you have engaged in any conduct which may violate applicable law or be harmful to us or our property or any third party or its property.

Emmel is a company based in Portugal, therefore every an any legal problem between us and our customers will be judged and assed by the Portuguese Law.
